Acceptable Use Policy

This Acceptable Use Policy sets out the rules for using the Glow Up Hub platform, website, and related services.

This Acceptable Use Policy ("AUP") sets out the rules for using the Glow Up Hub platform, operated by K&L Collective Pty Ltd (ACN 699 071 746) ("Glow Up Hub", "we", "us", "our") website, and related services ("Platform"). It applies to all users including salon owners, staff users, and trial users ("you", "user").

By accessing or using the Platform in any capacity, you agree to comply with this AUP. This AUP forms part of our Terms and Conditions and should be read together with our Privacy Policy and Data Processing and Sharing Agreement.

1. Purpose of the Platform

Glow Up Hub is a knowledge management and staff training platform designed for beauty business owners. It is intended to be used to:

  • upload and manage business policies, SOPs, and training content;
  • train an AI Staff Assistant on business-specific knowledge; and
  • provide staff with access to documented business information and guidance.

Any use of the Platform outside these intended purposes may constitute a breach of this AUP.

2. Who This Policy Applies To

This AUP applies to:

  • salon owners and business operators who subscribe to the Platform under a paid or trial plan ("Customers");
  • staff members and employees authorised by a Customer to access the Platform ("Staff Users"); and
  • any other person who accesses the Platform including during a free trial period.

Customers are responsible for ensuring that their Staff Users are aware of and comply with this AUP. A breach of this AUP by a Staff User is treated as a breach by the Customer.

3. Permitted Uses

You may use the Platform to:

  • upload, store, and manage your own business documents, policies, and procedures;
  • train your AI Staff Assistant on content relevant to your business;
  • allow your authorised Staff Users to access your business knowledge base;
  • access Platform Content including national laws, industry regulations, and compliance guidance provided by Glow Up Hub; and
  • communicate with Glow Up Hub support in connection with your account.

4. Prohibited Uses

4.1 General Prohibitions

You must not use the Platform to:

  • violate any applicable Australian law or regulation, including the Privacy Act 1988 (Cth), the Australian Consumer Law, the Spam Act 2003 (Cth), or the Fair Work Act 2009 (Cth);
  • infringe the intellectual property rights of any third party, including uploading content that you do not own or have permission to use;
  • upload, store, or transmit any content that is unlawful, defamatory, harassing, threatening, abusive, obscene, or discriminatory;
  • attempt to gain unauthorised access to any other Customer's account, data, or AI environment;
  • reverse engineer, decompile, copy, reproduce, or attempt to extract the source code of any part of the Platform;
  • use automated tools, bots, scrapers, or scripts to access, collect, or interact with the Platform without our written permission;
  • deliberately introduce malware, viruses, or any other harmful code into the Platform;
  • use the Platform to send unsolicited commercial communications or spam;
  • share your account login credentials with any person who has not been added as an authorised Staff User; or
  • resell, sublicense, or otherwise commercially exploit access to the Platform without our written consent.

4.2 Beauty Industry Specific Prohibitions

Given the nature of Glow Up Hub as a platform serving the beauty industry, you must not use the Platform to:

  • upload your clients' personal information, health records, allergy histories, or treatment notes without ensuring this is lawful and necessary for staff training purposes;
  • store or process sensitive client information including health information as defined under the Privacy Act 1988 (Cth) beyond what is strictly required for the knowledge management purpose of the Platform;
  • create or distribute content that provides specific medical, legal, or clinical advice to clients as a substitute for professional consultation;
  • upload content that makes false, misleading, or unsubstantiated claims about beauty treatments, products, or their results in a manner that would breach the Australian Consumer Law or the Therapeutic Goods Act 1989 (Cth);
  • use AI-generated responses from the Platform as a definitive source of compliance guidance for skin penetration services, chemical treatments, or other regulated beauty procedures without verifying the information against current applicable standards; or

use the Platform to circumvent or undermine your obligations as an employer under the Fair Work Act 2009 (Cth) or applicable Modern Awards, for example by using Platform-generated content as a substitute for proper employment contracts or legally required documentation.

5. Content Standards

All content you upload to the Platform must:

  • be accurate and not misleading;
  • comply with all applicable Australian laws and regulations;
  • not infringe the intellectual property rights of any third party;
  • not contain personal information about your clients beyond what is necessary and lawful for staff training purposes; and
  • be relevant to the purpose of staff training and knowledge management.

You are solely responsible for the content you upload. Glow Up Hub does not review or moderate Customer Content and accepts no liability for content that breaches this AUP or applicable law.

6. Account Security

You are responsible for maintaining the security of your account. You must:

  • keep your login credentials confidential and not share them with unauthorised persons;
  • use a strong and unique password for your account;
  • add Staff Users through the Platform's authorised user process rather than sharing login credentials;
  • notify us immediately at hello@glowuphub.com.au if you become aware of any unauthorised access to your account or any suspected security breach; and
  • ensure that Staff Users who leave your business have their access removed promptly.

We are not liable for any loss or damage arising from your failure to maintain account security.

7. Consequences of Breach

7.1 Warning

If we reasonably believe you have breached this AUP, we will in the first instance issue a written warning by email describing the nature of the breach and the action required to remedy it. We will allow a reasonable period to remedy the breach, which will be specified in the warning notice.

7.2 Suspension

If the breach is not remedied within the period specified in the warning notice, or if the same breach recurs after a warning has been issued, we may suspend your access to the Platform. During suspension, your data will be retained and you will not be charged for the suspension period beyond your current billing cycle.

7.3 Immediate Action for Serious Breaches

Notwithstanding clause 7.1, we reserve the right to suspend or terminate your account immediately and without prior warning where:

  • the breach involves unlawful activity or poses a risk to the security or integrity of the Platform or other Customers' data;
  • the breach involves uploading content that is defamatory, abusive, or discriminatory;
  • the breach involves an attempt to access another Customer's account or data; or
  • we are required to act by law or a regulatory authority.

7.4 Termination

Repeated breaches or a single serious breach may result in permanent termination of your account. In the event of termination for breach, no refund will be provided for any unused portion of your Subscription period. Your data will be retained for 30 days following termination in accordance with our Data Processing and Sharing Agreement.

8. Reporting a Breach

If you become aware of any use of the Platform that breaches this AUP, including by another user, please report it to us at hello@glowuphub.com.au. We take all reports seriously and will investigate promptly.

9. Changes to This Policy

We may update this AUP from time to time. We will notify you of any material changes by email at least 30 days before the updated policy takes effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated AUP.
